The Greater Noida Industrial Development Authority (GNIDA) on Tuesday issued showcause notices to four prominent builders for giving possession of flats in their projects without obtaining the mandatory completion certificate.
The builders have been given 15 days to reply.
The move follows repeated complaints by residents and homebuyers about builders deviating from the approved plan and leaving buyers with no option but take possession of flats.
"We have been conducting inspection of the projects in Greater Noida. No builder flouting norms will be spared," said P C Gupta, additional CEO, GNIDA.
"It's mandatory for the developer to get the original building plan sanctioned by the authority and then sell flats after acquiring completion certificate for the project. Completion certificate must be obtained and deed of apartment must be executed and registered by builder before giving possession of a flat," Gupta said. "We had issued a public notice in this regard last year," he added.
"Living in projects for which completion certificates have not been acquired can have multiple implications for the residents such as delayed possession and at times the open green areas giving way to concrete towers," Gupta said. A builder usually gets the building plan amended, with approvals for additional apartments and area, when his project is almost complete.
"Builders found to be handing over possession of residential units without obtaining completion certificate will be penalized as this is a violation of the UP Apartment Act 2010 under Section 4(5)," the ACEO said, urging residents to report instances of builders forcing them to take possession of flats without a completion certificate.
Such allottees can write to the general manager (planning and architecture) of GNIDA. They can also contact customer relations cell at GNIDA offices or send an email to gmplanning@gnida.in.
