NGT tells Centre to consider plea against exemption of green nod for large real estate projects


The National Green Tribunal (NGT) has directed the ministry of environment and forests (MoEF) to consider the objections raised by a petitioner against exempting real estate projects from the environment impact assessment (EIA) process. The environment ministry had recently issued a draft notification which said the environmental clearance for large real estate projects will be incorporated in the building permits.

The draft notification is an amendment to the Environmental Impact Assessment Notification 2006 which makes it mandatory for any building project above 20,000 square meters to obtain environmental clearance (EC).

NGT, in its order on Friday, stated: “We direct the environment ministry to consider the objections of the applicant before issuing a final notification…” The petitioner, Vikram Tongad, had raised objections to the Delhi Development Authority’s (DDA) unified building byelaws which incorporated the MoEF draft notification and stated that environmental concerns will be “integrated” in the building plan approval process and that the local bodies will be empowered to “approve and certify” environmental compliance.

“NGT has said the ministry will consider our concerns with exemption of environmental clearance for real estate projects. If they don’t, we are allowed to move NGT again,” said Tongad.
